Abstract

In Islamic Fiqh, the freedom to have a different opinion is based on strong arguments that are backed by knowledge-based research. Difference of opinion is a natural phenomenon because Allah Almighty has bestowed man with the faculties of contemplation, research and inquisitiveness. A Scholar carefully observes his surroundings and then analysis it. Finally, he reaches a conclusion and then forms an opinion after this contemplation. This is called a point of view. There are many religious issues that have not been conclusively decided by the quran and sunnah. Instead, these have been left at the discretion of scholars and jurists. This means that Holy Quran and Sunnah not only give the freedom to have difference of opinion on some matters of law, but also encourage jurists to undertake such research. This is cannot be denied that freedom of speech naturally gives rise to difference of opinion Even the Prophet's companions held different opinions on many religious matters. This tradition of having different points of view on the same issue was also continued by jurists and scholars in later ages, as well as in the contemporary age. However, it is important to remember that all such different points of view must always be based on religious research and valid arguments. Along with having difference of opinion, all jurists always adhered to a strict code of ethics that are based on mutual respect. So it is necessary that the jurists of the contemporary world that they should always have a broadminded view while having difference of opinion. They should always stay away from self-interest and prejudices and adhere to the ethics of mutual respect.
